| 设立法官遴选委员会和惩戒委员会是司法改革的重要举措。由于缺乏中央层面统一设计,导致实践运作模式上存在较大差异,产生了遴选(惩戒)委员会合并设置与遴选、惩戒委员会分设两种机制。两种机制各有利弊,产生的实际效果也不尽相同。文章通过对法官遴选、惩戒委员会两种不同的机构设置模式进行探讨,进而论证机构设置的优化选择方案,以期为科学合理地设置法官遴选、惩戒委员会做出有益探索。 |

| The establishment of the selection committee and disciplinary board of judgers are important initiatives for judicial reform,since,as a totally updated one in the recent judicial reform,the mechanism of judgers' selection and disciplinary approaches caught the public's attention again.The lack of operational experience makes the pilot project be a sound choice and thus,as a result of limited guidance standard,the operation shows significant differences and results into two different solution:merger or branching.This article took a subjective look at the installing mode of these two institutions and the optimization of that,discussed how to organize these institutions in a more rational way,which might consolidate the judicial reform. |
