| 依命令之职务行为的合法化前提是必须存在一定有效的、具有约束力的命令。有效、约束命令的范围为不明显违法的命令。是否明显违法，应当从命令的形式和内容两个方面进行考察。对有效、约束命令的认识错误属于对合法化事由前提条件的认识错误，应阻却故意的成立；在法律规定处罚过失犯的情况下，成立过失犯罪。 |

| The premise of legalization of duty act in accord with the order is the existence of the effective restrictive order. The scope of the effective restrictive order is the inconspicuously illegal order. The conspicuous illegality should be judged by the form and content of the order. The cognitive mistake of the effective restrictive order belongs to the cognitive mistake of the premise of the legitimate reason which eliminates the existence of intent. It will result in committing a crime with negligence which is has been stipulated in the law. |
