| 企业合规不起诉制度的推行不仅改变了检察机关在企业犯罪治理中的角色定位,而且极大地丰富了检察裁量权,然而权力扩大的本身就存在滥行的风险,加之企业合规不起诉中协商程序失衡、检察裁量边界不明、裁量权监督制约不力,可能导致检察机关司法适用随意、制度的犯罪预防功能异化、被害人合法权益难以保障甚至引发公众的司法认同危机。通过对域外企业合规起不诉裁量权控权模式的考察,司法监督模式符合现代控权机理与国际控权趋势。对此,我国应在遵循司法监督模式控权思路的前提下,通过建立司法审查制度、明确检察裁量基准、完善程序公开制度,实现对我国企业合规不起诉中检察裁量权风险的有效法律规制。 |

| The implementation of non-prosecution system in corporate compliance not only changes the role of procuratorial organs in the governance of enterprise crimes, but also greatly expands the scope of prosecutorial discretion. However,there are risks of being abused caused by the expansion of authority.And the imbalance of consultation procedures in corporate compliance non-prosecution,the unclear limit of prosecutorial discretion, and the ineffective supervision and restriction on discretion may lead to arbitrary judicial application of procuratorial organs, functional alienation of crime prevention of corporate compliance,difficulty of protecting the legitimate rights and interests of victims and even lead to the crisis of judicial identity in the public.According to the investigation of the discretion control mode in corporate compliance non-prosecution of foreign countries,the external supervision mode conforms to the modern mechanism of power control,the international trend of power control and the control requirement of? corporate compliance non-prosecution discretion.Therefore,on the premise of following the external supervision mode to realize control of power, China should establish the judicial review system of judges, make clear the benchmark of prosecutorial discretion, and construct the maximum disclosure system of corporate compliance, so as to realize the effective legal regulation of prosecutorial discretion risks in corporate compliance non-prosecution. |
