| [目的/意义] 欧盟通过《人工智能法案》、《通用人工智能行为准则》等法规、政策构建的生成式人工智能监管体系,为全球AI治理提供了系统性解决方案,对我国具有较重要的理论参考价值和借鉴意义。[方法/过程] 运用文献综合分析法和比较方法,首先对目前相关研究进行文献综述,找准研究突破口；进而简要阐述欧盟有关生成式人工智能监管的法规、政策；然后将中、欧生成式人工智能监管情况予以比较,并分析欧盟经验对我国借鉴的适用性；最后,提出对我国的有益借鉴。[结果/结论] 结论认为,欧盟经验对我国具有有益的借鉴作用,主要表现在以下4个方面：制订切实可行的法规、政策,为我国生成式人工智能的监管“保驾护航”；构建分层分类的动态监管体系；强化透明度与伦理约束机制；平衡监管与创新的发展路径。 |

| [Purpose/Significance] The regulatory framework for generative artificial intelligence established by the European Union through regulations and policies such as the "Artificial Intelligence Act" and the "General Artificial Intelligence Code of Conduct" provides a systematic solution for global AI governance, which holds significant theoretical reference and learning value for China.[Method/Process] Utilizing the methods of comprehensive literature analysis and comparison, this study first conducts a literature review of current relevant research to identify research breakthroughs; then briefly expounds on the regulations and policies of the European Union (EU) regarding the regulation of generative artificial intelligence (AI); subsequently compares the regulatory situations of generative AI in China and the EU, and analyzes the applicability of the EU"s experience for China"s reference; finally, proposes beneficial references for China.[Result/Conclusion] The conclusion is that the EU experience serves as a useful reference for China, mainly in the following four aspects: formulating practical and feasible regulations and policies to "escort" the regulation of generative AI in China; constructing a dynamic regulatory system based on hierarchical classification; strengthening transparency and ethical constraints mechanisms; and balancing the development path of regulation and innovation. |
