| 我国很长一段时间以来都采用客观真实来指导和解释事实认定和证据调查,后来学界又提出用法律真实代替客观真实。客观真实认为只要收集证据,一定能还原事实真相,一切都是可知的,忽略了认识主体的差异性；法律真实注重形式主义,甚至可能掩盖真实,法学理论界和司法实务界对应该坚持客观真实还是法律真实的标准存在争议。共识性真实为法律事实提供真实性标准,以证据为基础,借助语言进行相互说服和论证,通过言语进行有效的沟通使双方达到内心的认同感而促成共识,运用哈贝马斯商谈视角以及交往理性和真理共识理论,梳理相关理论,结合民事诉讼特定语境,寻找新的路径。因此,民事诉讼中应当是共识性真实。 |

| For a long time in our country, objective truth has been used to guide and interpret factual determination and evidence investigation. Later, the academic community proposed using legal truth instead of objective truth. Objective truth holds that as long as evidence is collected, the truth of the matter can be restored, and everything is known, ignoring the differences in the cognitive subjects; Legal truth emphasizes formalism and may even conceal truth. There is controversy in the legal theory and judicial practice circles over whether to adhere to the standard of objective truth or legal truth. Consensus based truth provides a standard for the authenticity of legal facts, based on evidence and using language to persuade and argue with each other. Effective communication through language enables both parties to reach a sense of inner identification and promote consensus.Using Habermas' perspective of negotiation, communicative rationality, and consensus theory of truth, relevant theories are sorted out and combined with the specific context of civil litigation to find new paths. Therefore, consensus based truth should be used in civil litigation. |
