| 建立失信被执行人信用修复机制具有重要的现实价值,在政治效果上可以促进社会治理体系和治理能力现代化,在法律效果上可以从源头切实解决执行难问题,在社会效果上落实善意文明的执行理念。尽管建立失信被执行人信用修复机制具有多重意义,但是构建我国失信被执行人信用修复机制仍然面临着许多问题与困难。首先在理论上存在分歧,各方对失信被执行人信用修复机制的内涵有不同解读；其次在实践过程中,失信被执行人信用修复机制的构造也不同；最后在程序方面也存在失衡,被执行人信用修复缺乏可操作性。针对不同的问题提出不同对策:第一,科学界定失信被执行人信用修复机制的内涵。第二,完善失信被执行人信用修复机制。第三,完善失信被执行人信用修复机制的操作环节。 |
