| 中国一年一度的优秀法官评选已成为我国司法界的一件大事。这种评选除了法律技能方面的要求外,更多地还包含着政治伦理、传统美德、感人品德等方面的标准。因此,评选出来的优秀法官身上体现着一种“泛道德化”现象。这种现象的出现在一定程度上是合理的和必然的,是有其社会上、文化上的客观原因的。不过,这种现象对中国法治建设也有一定的负面作用,它对当代中国司法职业化、规范化、形式化要求也存在着不利的影响。如果要发挥我们的各种道德优势又要克服相关的不足,那只有加强相关评选制度和职业运行制度建设,进一步整合我国司法活动中的各种优势。 |

| China's annual selection of outstanding judges has become a major event in China's judicial circle. In addition to the requirements of legal skills, the excellence of judges also contains more political, traditional and emotional standards. Therefore, the appearance of this phenomenon is reasonable and inevitable to a certain extent, and has its social and cultural objective reasons. However, this phenomenon also has a certain negative effect on the construction of the rule of law in China. It also has a negative impact on the requirements of the professionalization, standardization and formalization of contemporary Chinese justice. If we want to give full play to our political and moral advantages and overcome its shortcomings, we must strengthen the construction of relevant systems and further integrate the various advantages in our judicial activities. |
