| “劳动股份制”是让劳动者参与分享企业利润的一种法律制度,即劳动者可与投资者通过共决等方式,确定双方分享企业一定比例的利润,并在此比例确定的范围内,投资者按照《公司法》等相应的规定,劳动者按照“劳动股份制”立法的规定分享利润并承担义务,促使两者的立法相互衔接与协调。在国际社会经济危机频发,某些资本主义强国愈发难以转嫁经济危机、资本已是相对过剩的背景下,坚持“以人民为中心”,推进“劳动股份制”的专门立法,完善配套的法律制度,保障劳动者对剩余价值所应享有的权益,促进资本积累与劳动力扩大再生产的相对平衡,是达到经济社会可持续的高质量发展的法律保障,也是反对经济霸权干涉、阻止资本主义国家转嫁危机的长效法律措施,这将对于一切遵循经济全球化规则,致力于和平与发展的民族与国家,具有一定的普适性。 |
