| 志愿者侵权责任分配应坚持志愿服务组织替代责任为主、志愿者个人责任为辅的原则。我国志愿者侵权责任分配及免除制度还存在立法体系不完善、保险体系不健全、经费保障不到位等问题，需要尽快制定《志愿服务法》加强对志愿者侵权责任分配及免除制度的法律保障，并通过健全志愿者侵权公众责任保险等方式优化志愿者保险体系内部结构，加强志愿服务经费保障力度，以期进一步完善我国志愿者侵权责任分配及免除制度。 |

| Volunteer tort liability allocation shall adhere to the principle of taking voluntary service organizations vicarious liability as the main, and volunteers personal responsibility as supplement. In our volunteer tort liability allocation and exemption system there are also many problems such as that the legislative system and insurance system are still imperfect, the volunteer service funding is not in place, so we should take measures such as establishing as soon as possible "volunteer service law" to strengthen legal protection for the volunteers tort liability allocation and exemption,and optimize the structure of volunteers insurance system, strengthen the volunteer service funding, in order to further improve our volunteer tort liability allocation and exemption from liability. |
