| 新形势下职务犯罪的侦查模式面临着“惩罚犯罪”与“保障人权”有机统一的法制环境。当前，我国职务犯罪侦查模式的结构性矛盾没有根本变化，侦查过程中“老办法不管用、新办法不会用、硬办法不能用”的局面令人困惑。为此，要牢固树立“人本主义”的司法理念，确立“以客观性证据为中心”的思维模式，使用“柔性”侦查讯问方法，注重律师作用的充分发挥，构建“信息引导侦查”体系，从而实现我国职务犯罪侦查模式的转型升级。 |

| Under the new situation, the investigation mode of duty crime confronts with the legal environment which the punishment of crime and the protection of human rights were organic unity. At present, the structural contradiction of the investigative mode of duty crime in our country haven't fundamentally changed. In the course of the investigation, we are confused about the situation that the old way didn't work, then we didn't use the new approach, at last we can't use the tough way. Therefore, and we must firmly establish the humanism of judicial idea and the investigation system guided by information, and we also should build thinking mode which focuses on the objectivity of evidence. Moreover, we should use flexible interrogation method and pay attention to the importance of lawyer. Finally the transition and promotion of investigative mode of duty crime in our country will come true. |
