| 整齐划一的征收补偿，往往会导致形式正义掩盖实质正义。因此，以罗尔斯正义论的差别原则作为理论依据，探讨征收补偿的修正，有利于切实保障弱势群体的利益。这种差别原则下的征收补偿修正，应该既考虑“量的补偿”，又兼顾“质的补偿”，既考虑“当下补偿”，又考虑“未来保障”。不过，由于征收补偿修正，是法律之外的伦理修正，没有统一标准和现成模式照搬，因而，必须以严格的原则和严谨的程序予以规范。 |
