| 严格责任是英美法系刑法中一个特有的概念，分为绝对严格责任和相对严格责任。绝对严格责任虽然具有一定的合理性，但由于其不符合罪过理论和主客观相统一的刑法原则以及正义方面的缺陷，应予否定。相对严格责任克服了绝对严格责任的缺陷，体现出相当的合理性，应予肯定。相对严格责任引入我国时应从程序和实体两个方面进行具体设计。 |

| Strict liability is a special concept in Criminal Law in Anglo-American Law System. It can be divided into absolute strict liability and comparative strict liability. Although absolute strict liability has certain rationality, yet it doesn't accord with Culpability Theory and criminal law principle of unity of subject and object with defect in justice, it should be denied. Comparative strict liability overcomes the defect of absolute strict liability and embodies considerable rationality, so it should be affirmed. When we bring in comparative strict liability, we should make detailed design in two aspects of program and entity. |
