| 自由和秩序是人类生存和发展的重要保障，现代社会依靠法律制度来保障个体自由和社会秩序，因此自由与秩序是法律所追求的主要价值目标。然而对自由与秩序的认识和取向在中西方之间有很大不同。这种差异导致了中西方之间整个政治、社会与法律制度的截然不同。中国进入转轨时期，面对着西方自由主义思想和各种制度的冲击，出现了自由与秩序失衡的状态。寻求自由与秩序的动态平衡对于转轨时期的中国明确发展方向，保障人们的自由和维持社会的稳定具有相当重要的作用。 |

| Liberty and order are the essential elements for the living and development of human beings, which are guaranteed by institutions of law in modern society. Liberty and order are the fundamental value of law. It can not be denied that there exists wide difference on the cognition and orientation of liberty and order between the East and the West, which leads to complete difference of political, social and law system. With the impact of Western liberal thought and institutions in this transitional period, China is in the state of imbalance between liberty and order, therefore, to seek dynamic equilibrium between liberty and order is of great importance to people’s freedom and social stability of China. |
