| 法家的“法治”思想是中国传统法律思想发展的高峰，在中国法律思想史上占有特别重要的地位。在现今正致力于法治建设的社会语境下，“法治主义”又成为学术界和实务界热门的语汇，先秦法家的“法治”思想再次引起人们的关注。通过对法家所提出的“法治”思想的理论基础和特色的分析，指出这种“法治主义”实质上是一种极端的人治，与现代法治理念有着根本的区别。 |

| Legalists' "rule of law" idea is the peak of the development of traditional Chinese legal thinking,and occupies a particularly important position. in the history of legal thought in China. In today's social context, the "rule of law doctrine" has become a hot sector, the academic and practical vocabulary. Through analyzing the ideological basis and characteristics of the “rule of law”theory proposed by the legalists,this paper notes that the "rule of law doctrine" is essentially an extreme rule of man, and has a fundamental difference from the modern concept of the rule of law. |
