| 政治权利是公民权利让渡的结果，政治权力的运用必须坚持公益的目标，服从公共意志的约束。但是，由于现实情境的复杂多变性，为了更好的保护公共利益，就必须赋予政府部分自由裁量权，这就是“特权”。阐述洛克的特权理论，有利于我们对洛克的社会契约理论理解的深化，可以进一步丰富现代自由裁量理论。 |

| Political rights are the results of alienation of civil rights. The use of political power must uphold the public interest objectives and subject to the constraints of public will. But due to the complex nature of the real situation，in order to protect the public interest better， the government must be given part of the discretion ，which is the "privilege”.Describing the Locke’s privilege theory is conducive to our understanding of Locke's social contract theory deep and can further enrich the modern theory of discretion. |
