| 现代社会发展模式的背景既需要行政裁量的灵活应对作用，又不得不对其进行一些限制。在这样一种矛盾情形下，裁量基准制度因其自身的相对性特征、适用范围不确定等问题，面临着诸多的困境。要走出这些困境，就必须构建合理的裁量基准打破机制，恰当的定位其有限的作用和适当的适用范围，这样才能正确发挥裁量基准制度可以被期待的作用。 |

| Under the background of modern model of social development,we need the flexibility of administrative discretion,but also have to set some restrictions to it. In such a contradictory situation, because of the character of relativity and the uncertainty of its scope,discretion standard system will face so many dilemmas.To overcome these dilemmas, we must design a reasonable mechanism for the breaking of discretion standard,and seek the proper positioning for the limited function and applicable scope of it.Only in this way,can discretion standard implement its function correctly in view. |
