| 高校管理法律关系包括学校与学生,学校与教师及教师与学生的法律关系，在这三对法律关系中，高校与学生的法律关系是主要的，决定着其他两个法律关系性质。高校与学生的法律关系本质上是一种特别的民事法律关系（教育契约）；教师是高校的代理人，学生与教师之间的法律关系是基于代理关系下的特别民事法律关系。 |

| Legal relatons of management of higher education includes three kinds of relations, that is, college and students, college and teachers, teachers and students. The legal relation between college and students is the main subject, which is basically a kind of special civil legal relations (educational contract) and decides the properties of the other two relations. Teachers are the agents of college. The legal relation between students and teachers is a special civil legal relation based on agent relation. |
