| 在自然属性、文化特征等方面，道地药材与地理标志有着许多的契合点，以地理标志制度对道地药材予以保护被认为是最为适宜的一种工具。但我国现行法律采用商标法与专门法结合的“混合保护模式”，容易产生权利冲突。理顺法律关系，协调主管部门的职能，明确质量标准，实施“国家地理标志战略”，以推动我国道地药材产业的发展。 |

| In the aspect of natural attribute and cultural characteristics, genuine medical materials and geographical mark have many similarities while the system of geographical mark is regarded as the most appropriate tool to protect genuine medical materials. However, the mixed protection model which combined Brand law and specialized laws carried out in China now is easy to lead to the conflicts of authoritative rights. The actions of putting laws relations in order, coordinating the function of the governing departments, specifying quality standard, nurturing leading enterprise, and implementing national geographical mark strategies have practical significance to the development of genuine medical material industry. |
