| 文章从法哲学阐释的角度,将法律翻译看作语言和认知交互作用的结果,通过对立法文本句式在翻译过程中所隐含的语法动态整合的认知操作分析,揭示法律翻译在生成过程中概念和语言整合操作的异同并指出：法律翻译是法律、语法、哲学等因素构成的框架内的积极而有限制的创新过程；法律翻译依赖于诠释法律文本所形成的理论和译者的理解创新。 |
| English Summary: |
| This paper, from the perspective of philosophical principle of legal interpretation, regards translation as the result of the interaction between language and cognition. Based on the analysis of the dynamic grammatical blending and cognitive operations involved in the process of legal translation, this study proposes a unified translation framework for the cognitive operations in translating grammatical constructions and points out: legal English translation is a creative process with a frame of combining law, grammar and philosophy. While doing legal English translation, a translator’s comprehension of a legal text from the theories of interpretation of law of jurisprudence and the translator’s creation in legal English translation direct the translation. |
