| 人工体外授精子女(即试管婴儿)是科学技术发展条件下现代人工生殖技术成功运用的产物,其在满足了人类享受天伦之乐的同时,也对传统以血缘关系说为基础的亲子观念和理论提出了挑战。由于培育试管婴儿的精子、卵子的供体来源不同,便产生了子女往往有"多个父母"的现象,因而引发了一系列伦理、道德和法律问题,而问题的关键在于如何认证试管婴儿的法律地位。文章基于此,就培育试管婴儿的精卵子的法律性质进行了辨析和探讨,并在此基础上提出了从物权视角根据不同情形将该精卵子界定为物权之客体而有助于试管婴儿的法律地位认证的构想。 |

| Children artificial in vitro fertilization(IVF)is the product of modern artificial reproductive technology successfully appled under the conditions of the development of science and technology which meet the enjoyment of family happiness of mankind,at the same time,it also has posed a challenge to the concepts and theories paternity based on the conventional blood relationship.Because nurturing IVF sperm and egg donors come from different sources,they often lead to the phenomenon that children have "a number of parents" and,therefore,trigger a series of ethical,moral and legal issues,and the crux of the problem lies in how to certify test-tube babies legal status.Based on this,the paper discriminates and explores the legal nature of nurturing IVF sperm and egg donor,and proposes to define egg and sperm donors as the object of property rights under different circumstances,which will contribute to certify the legal status of IVF. |
