| 商业银行破产是市场竞争的必然产物,但银行业的特殊性及现代破产制度价值结构的变化决定了宣告商业银行破产需考虑各方面的因素,其不能像一般企业一样过于简单地退出市场。在对商业银行破产标准的认定上,也应有其特殊性。我们应该针对其特性,有必要专门规定判断商业银行破产的指标体系,而且这一指标不应仅仅是法律意义上的指标,更应该是金融意义上、经济意义上指标,文章对这些指标体系作了初步的构想。 |

| The Commercial banks bankruptcy is the inevitable product of market competition,but the particularity of banking industry and the change of the modern bankruptcy system value structure determine that announcing a commercial bank's bankruptcy need to consider factors of everyone's noodles,it can't be like an ordinary business enterprise withdrawing from the market.As to affirming the bankrupt standard of commercial banks,the particularity should be considered.Based on its characteristics,it is a necessity to make the index sign system of the bankruptcy exclusively,which should be not only a law meaning's,but also a financial meaning, economic meaning's index sign.The article has made the first speculation of these index sign systems. |
