| 《关于确定民事侵权精神损害赔偿责任若干问题的解释》是我国人身权利保护方面的具有里程碑意义的规范性法律文件。文章提出“精神损害赔偿“无法周延地概括精神抚慰制度,并从四个角度透视了该解释:权利型客体的重新排序、法人或其他组织的精神抚慰制度的新建、“一事不再理”诉讼原则的新认识、残疾赔偿金和死亡赔偿金新解。以期使精神抚慰制度以较完整的体系体现在已列入立法规划的《侵权责任法》中。 |

| "Explanations About Determination of Civil Right infringement of Spiritual Damage compensation Responsibility" is the milestone for e the standard legal document of our country's personal rights protection. The author proposes "the spirit damage compensation" is unable to summarize the system of comforting,and should explain it from four perspectives: the right object rearranging,the newly building of the legal person or other organization's spirits comfort system newly building,new understanding of "twice no action and judgement for the same case" lawsuit principle,new solution for disabled and the death indemnity.causing the spirit comfort system to included in the legislation plan of "Right infringement Responsibility Law". |
