| 立法不公的现象越来越受到关注。在造成立法不公正的诸多原因中,立法程序的不正当往往位居于关键位置。然而,立法程序的正当性学理分析一直受到忽视,原因既在于传统上我们对程序法的研究不够重视,更在于传统上关于法的本质的片面观点窒息了我们对立法程序进行正当性分析的学术空间。事实上,基于其“造法之法”的独特程序法地位,立法程序的正当性是良法得以生成的逻辑前提。立足于正当性与实质价值论间的相互关联性,立法程序的正当性可以通过其价值基础、正义诉求和伦理本质三个方面体现出来。 |

| The unjust phenomena of legislation has been cared for increasingly.Among all causes that resulted in this phenomena,the uppermost is unjustified legislative process.However,the analysis to legislative process in justification has been ignored.There are two matters causing it in our tradition: firstly,the study of due process has been ingored;secondly,the unilateral viewpoint about essence of law has baffled our interest in studying legislative process.In fact,being a special process that builds laws,due Legislative process is logistical precondition that gives birth to good laws.In the authors'opinions,due legislative process can been analysed in three aspects: its foundation of value,its pursuing for justice,and its ethical essence. |
