| 传统环境法是指经济优先,以环境污染防治为核心的传统型环境法体系。现代环境法是指经济利益与生态利益兼顾,污染防治与资源保护并重,包含可持续发展精神在内的环境法体系。两者在立法精神、保护对象、法律价值方面存在着不同,环境法应走向现代化,实现从“实然”到“应然”的转变,实现社会、经济、环境保护共同的可持续发展。 |

| Traditional environment law refers to a system which gives priority to economy and centers on the prevention against environment pollution.Modern environment law gives consideration to both economical and ecological benefits, both pollution prevention and resources protection,and includes the system of sustained development spirit.The two laws differs from each other in legislation spirit,protection subjects,and law value.Environmental law should be modernized and remain developed in society,economy and environment protection. |
