| 消费者受到第三人侵权时,经营者如果没有尽到安全保障义务,应适用过错原则,承担补充责任,以防止对经营者的过度归责倾向。我国某些司法解释已经引进了这一制度,但学术界对此有所争议。因此,有必要对经营者补充责任的含义及构成要件,补充责任的性质,归责原则以及效力等问题进行论述和探讨,以完善我国损害赔偿法的相关内容。 |

| When consumers are encroached by the third people, whether proprietors perform the obligation should be measured by the principle of fault. If proprietors don' t fullfil the obligation of safety, they should bear supplement responsibility, and excessive obligation of the proprietors should be prevented. Some judicial interpretations introduce the system, but the academic community is not in agreement. So it is necessary to explore some important questions, exclusive of the definition and constitutive requirements of supplement responsibility, the nature, the principle of obligation and legal effect, in order to perfect the related content of the compensation for damage law. |
