| 依据现代宪政理念,为了保障市场主体的经济自由,并同时对政府的经济调制行为予以规制,我们必须赋予市场主体以经济权利并厘定政府经济权力的边界,这是经济宪法的第一要务,也只有在当宪法真正履行着它的道德承诺,真正确定政府机构对全体公民的经济义务而限制经济权力的时候,它才具有合法性。经济法法权合法性分析必须在此前提下展开,才能构建和谐的市场经济秩序和理性的权利(力)结构,使市场经济主体作出合乎本性的自然选择,实现自我的经济福利。 |

| Based on modem constitutional idea, in order to safeguard the economic freedom of the market subject, and at the same time to regulate the economic modulation behavior of the government, we must endow the market subject with the economic right and demarcate the boundary of the government's economic power, which is the first important matter of the economic constitution, and also only when the constitution truly fulfills its morals pledges, truly determines government institution's economic duty to the all citizens and limits the economic power, the economic constitution has the legitimacy. The analysis for the legitimacy of the legal right in the Economic law must be launched under this premise, only then can constructs the harmonious market economic order and the rational right (power) structure, and makes the market economic subject to conform with the selection of nature, realizes the self- economic welfare. |
