| 欠薪保障优先权法律制度赋予了职工欠薪优于其他债权而受清偿或受保护的特权。欠薪优先清偿序位和欠薪保障资金优先是这一制度的两个主要方面。我国法律对于欠薪保障优先权的规定较原则,没有对清偿序位和保障资金分别作出规定,存在较多不尽合理的地方。文章分析我国欠薪保障优先权的缺陷并提出相应的改进建议,对于解决当前普遍存在的欠薪问题应当是有所裨益的。 |

| Law system of the right priority of safeguarding overdue salaries confirms that workers' overdue salaries are under liquidation and protection prior to other debts,which includes two main aspects: liquidation seqence and safeguard capital.But China's law system does not make respective regulations according to the two aspects,so there are some unreasonable problems.The paper analyzes the defects and presents suggestions. |
