| 在当下中国,明确高校学生管理的法律性质,其重要性不证自明。特别是在高等教育多元化、市场化的今天已成为一个刻不容缓的问题,文章从法权关系的视角,分析了高校学生管理行政性形成、发展的历程及其原因、高校管理体制改革对它的影响以及对高校学生管理的性质进行重新定位,其目的在于为妥处高校与学生之间的法律纠纷、推进高校学生管理体制改革提供一种新思路。 |

| It is very important to further define the legal nature of the student management of colleges and universities in China at the present time. Since nowadays the higher education has been pluralistic and oriented to market, it is a pressing problem to define the nature of the student management of colleges and universities. From the law-right relationship perspective, the author has analyzed the forming and developing course and the causes of the executive legal nature of the student management of higher education, the influence of the reform on it, and re-determined the nature of it in order to provide a new way to well handle the legal disputes between students and institutions and to advance the reform of the student management systems. |
