| 刑事诉讼非法证据排除规则是刑事证据制度中的重要内容。文章主要从成本与效益的视角对之进行考察,认为这一证据规则的成本主要在于立法、司法及一定程度实质正义的丧失,而它的效益体现在维护法律的权威、促进司法公正的实现、保障人权以及具有的社会教育意义。通过对比分析得出结论,认为我国应确立非法刑诉证据排除规则,并对如何确立我国的非法刑诉证据排除规则提出了立法建议。 |

| The principles of removing illegal evidence in criminal procedure is an important content in criminal evidence system. This paper discusses mainly from the aspect of cost and benefit, holding that the cost depends on legislation, judicature and the certain loss of genuine justice, and the benefit is reflected by defending the authority of law, realization of justice in jndicature, ensuring human rights and its social education sense. In conclusion, our country should establish principles of removing illegal evidence and some suggestions are presented. |
