| 有关事实的命题是回答"是"与"不是";有关价值的命题是回答"应当"与"不应当".从分析法学的视角看,把事实与价值区分开来,具有重大的理论意义.法学的发展史证明事实与价值的区分是分析实证主义法学批判自然法学的理论出发点;事实与价值的区分是法学作为一门科学得以独立存在的依据;事实与价值的区分是法律应该得到遵守和法律改革的理论依据. |
