房屋预售合同就其性质而言是买卖合同的一种 ,但不是一般的买卖合同 ,而是一种特殊形式的房屋买卖合同。它也不同于一般的分期付款买卖合同。它虽然是预售合同 ,但不是预约 ,而是本约。预售合同以登记为生效要件 ,这种登记不同于产权登记 ,房屋预购人取得的权利不是房屋的所有权 ,仍然是一种债权。 |

Forward house-selling contract is a kind of buying and selling contract in special form.The forward selling contract,different from the general instalment contract,is a principal not facultative contract.The forward selling contract becomes effective upon registration but it is not the same as the property right registration.The forward house purchaser can not obtain the ownership of the house but the creditor's right. |
